When landlords and tenants reach agreement after a tenancy dispute, making sure everyone is clear on what’s been agreed can save a lot of stress later.

Our FastTrack Resolution service is designed for situations where money is owed, such as rent arrears or unpaid water charges, and provides a simple way to formally record an agreement that has already been reached.

The key to success: a clear conversation up front

FastTrack works best when both parties are very clear about the agreement before an application is made. A mediator can only confirm the agreement if the tenant can clearly explain what has been agreed.

A strong agreement will clearly set out:

  • the amount owed, calculated up to the day before payments start
  • how the debt will be repaid, including any additional payments
  • the date payments will begin
  • the agreed consequences if the agreement isn’t kept.

How FastTrack Resolution works

Once an agreement has been reached, the landlord can submit a FastTrack application online.

A Tenancy Services mediator will contact the tenant to confirm they understand and agree to the terms. If everything is confirmed, the agreement is written up as a Mediator’s Order and sealed by the Tenancy Tribunal, making it legally binding.

This simple step can help stop issues escalating further and avoid the need for further mediation or a Tribunal hearing.

Example: how FastTrack Resolution can help with rent arrears

A tenant has fallen behind on rent and owes several weeks’ arrears. After talking things through, the landlord and tenant agree that the tenant will repay the outstanding rent through regular additional payments on top of their ongoing rent. They also agree on what will happen if a payment is missed.

Instead of attending mediation, the landlord applies for FastTrack Resolution. A mediator contacts the tenant to confirm they understand and agree to the arrangement. The agreement is then formalised as a sealed Mediator’s Order, giving both parties clarity and confidence, and reducing the risk of further disputes.

Note that if a termination clause has been agreed when a 14-day notice has been issued rather than because rent was more than 21 days overdue at the time of filing, FastTrack Resolution would not be a suitable option. These cases are better handled through a full mediation discussion with both parties.
